PERFANA SaaS | Fair Use Policy

As part of its commitment to providing a high-quality, fast and reliable service, PERFANA applies this
Fair Use Policy for its Software-as-a-Service solutions (PERFANA SaaS).

Purpose

This Fair Usage Policy contains guidelines for customers’ use of the PERFANA SaaS to ensure that
each customer should have a consistently high-quality experience when using the PERFANA SaaS.
PERFANA SaaS offers a multi-tenant service, which means that PERFANA SaaS can be used
concurrently by multiple customers. If a single customer places very high demands on the PERFANA
SaaS then it is possible that this will impact the experience for other customers.

The vast majority of PERFANA’s customers use the PERFANA SaaS considerately and their usage
levels during peak hours do not disproportionately affect the shared network and service capacity.
However, even if only a very small number of customers uses the PERFANA SaaS inappropriately,
such use may affect the use of the PERFANA Services for others.

This Fair Use Policy´s purpose is to manage inappropriate use by customers to ensure the PERFANA
SaaS can be used fairly by everyone. PERFANA takes measures to ensure the customer usage is
within reasonable parameters and in accordance with the rights granted to each customer (Fair Use).

Fair Use

Customers are required to adhere to a Fair Use of the PERFANA SaaS. To that effect, PERFANA
monitors the use by customers of the PERFANA SaaS on a continuous basis.

In the event a customer uses the PERFANA SaaS in an inappropriate manner (for instance by
generating an exceptionally high load over a short period of time), PERFANA reserves the right to
limit, restrict, or suspend (to be determined at PERFANA’s sole discretion) the customer´s access to
and use of the PERFANA SaaS (e.g. restrict the number of Systems under Test to be processed
simultaneously in order to protect the PERFANA SaaS or other customers’ usage thereof) or oblige
the customer to increase its subscription to the PERFANA SaaS to meet its actual use of the PERFANA
SaaS.

PERFANA understands that customers will occasionally have very high volumes of traffic outside of
normal usage patterns. In those cases where this traffic can be predicted by the customer, PERFANA
requires to be informed with as much notice as possible to ensure that PERFANA SaaS service
delivery remains consistently high.

The principles of this Fair Use Policy and the restrictions set forth herein apply to each use of the
PERFANA SaaS.

Miscellaneous

This Fair Usage Policy may be updated by PERFANA from time to time by notice to the customers
(including via email).
